Work Permits

Work Permits are issued to any Non-Kenyan wishing to engage in employment in Kenya whether in gainful employment or voluntary service. The Work Permits issued by the Department of Immigration are classified from A to M and depend on the type of occupation. They are issued under Kenya Citizenship and Immigration Act 2011 of Laws of Kenya.

 

The following are the various classes of Permits and their application and renewal requirements:

 

 

Class A: Issued to persons who intend to engage in prospecting for minerals or mining.

Requirements

- Duly filled and signed form 25.

- The necessary licences and registration to prospect for minerals to mine.

- Signed cover letter from the employer or organization addressed to the Director of Immigration Services.

- Copies of national passport.

- Two(2) recent passport size colored photos (for both new and renewal applications).

- Proof of sufficient capital or resources for investment.

- Copy of PIN certificate.

- Current license held for prospecting minerals and previous permits or passes (for renewals).

- Current, signed audited accounts for the last one year (for renewal).

Charges

-Kshs. 250,000 + Kshs 10,000 processing fee

Duration

2-4 months

Class B: Issued to persons wishing to invest in Agriculture and Animal Husbandry.

Requirements

- Duly filled and signed form 25.

- Signed cover letter from the employer or organization addressed to the Director of Immigration Services.

- Copies of valid national passport.

- Two(2) recent passport size colored photos (for both new and renewal applications).

- Sufficient capital or resources for investment.

- Proof of land ownership/leasehold.

- Copies of permits, passes, clearances and licences from the relevant bodies (for both new and renewal applications).

- Current, signed audited accounts for the last one year.

Charges

-Kshs. 10,000 processing fee

Duration

2-4 months

Class C: Issued to a person who is a member of a prescribed profession who intends to practise that profession in Kenya.

Requirements

- Duly filled and signed form 25.

- Signed cover letter from the employer or organization addressed to the Director of Immigration Services.

- Copies of valid national passport.

- Two(2) recent passport size colored photos (for both new and renewal applications).

- Proof of membership to a prescribed profession.

- Copies of academic and professional certificates including ones C.V.

- Copy of PIN certificate.

- Copies of any previous permits and passes. (for both new and renewal applications).

- Tax compliance certificate from KRA (for renewals).

-Kshs. 10,000 processing fee

Duration

2-4 months

Class D: Issued to a person who is offered specific employment by a specific employer who is qualified to undertake that employment.

Requirements

- Duly filled and signed form 25 and 27.

- 2 passport photo (for a new applicant)
- Photocopy of passport and current visa/re-entry pass
- Copy of Business Registration Certificate or certificate of incorporation from employer.
- Covering letter from Employer on letter head stating why they wish to renew/apply the permit.
- Copy of Company’s pin certificate (employer)
- Copies of academic/professional certificates along with the CV.
- Copy of original entry permit and/or passes (for renewal case).

- New applicants can extend visitors VISA up to six months while waiting for the immigration board’s decision.

- Renewal of permit should be done 3 months prior to expiry date

-Kshs. 200,000 + Kshs 10,000 processing fee

Duration

2-4 months

Class F: Issued to a person who intends to engage, whether alone or in partnership, in a specific manufacture in Kenya.

Requirements

- Duly filled and signed form 25.

- Signed cover letter from the employer or organization addressed to the Director of Immigration Services.

- Copies of valid national passport and current visa/re-entry pass.

- Two(2) recent passport size colored photos (for both new and renewal applications).

- Copy of PIN certificate.

- Proof of sufficient funds for investment.

- Registration certificate of the company.

- Certificate of Incorporation of the company.

- Shareholders certificate (CR12).

- Signed current audited accounts(for renewals).

- Tax compliance certificate from KRA (for renewals)

Charges

- Kshs 10,000 processing fee

Duration

2-4 months

Class G: Issued to investors in a specific trade, business or consultancy.

Requirements

- Duly filled and signed form 25 and 27.

- Cover letter stating how your investment will be of benefit to Kenya and state the number of Kenyan Employees.

- Registered trading name with the registrar of companies.

- Copy of Business Registration Certificate or certificate of incorporation.

- Copies of valid national passport and current visa/re-entry pass.

- Two(2) recent passport size coloured photos (for both new and renewal applications).

- Copy of personal and company PIN certificate.

- Copy of previous permits and passes.

- Proof of funds i.e. minimum Kshs.s.10 million bank statement from a local bank.

- Copy of audited accounts and tax compliance certificate (for renewal).

Charges

- Kshs 100,000 + Kshs. 10,000 processing fee

Duration

2-4 months

Class I: Work/Residence permit issued to a member of missionary society approved by the Government of Kenya and whose presence is beneficial to the country.

Requirements

- Duly filled and signed form 25.

- Signed cover letter from the organization addressed to the Director of Immigration Services.

- Copies of valid national passport.

- Two(2) recent passport size coloured photos (for both new and renewal applications).

- Copy of previous permits and passes (for renewal).

- Copy of the organization's registration certificate.

- Copies of academic and professional certificates.

Charges

-Kshs 1,000 processing fee

Duration

2-4 months

Class K: Residence permit issued to persons who have an assured income derived from sources outside and undertakes not to accept paid employment of any kind.

Requirements

- Duly filled and signed form 25.

- Signed cover letter from the organization addressed to the Director of Immigration Services.

- Copies of valid national passport.

- Two(2) recent passport size coloured photos (for both new and renewal applications).

- Copy of previous permits and passes (for renewal).

- Proof of annual assured income

Charges

-Kshs 100,000 + Kshs 10,000 processing fee
